Anthony Pellicano Pleads Not Guilty To Threatening Reporter

Back in 2002 there were two investigative reporters tearing up Hollywood. Bernie Weintraub of the New York Times and Anita Busch of the L.A. Times. They dug deep and reported all sorts of stories that the movers and shakers of Hollywood didn’t like. Many were about the then super-agent Michael Ovitz. Ovitz didn’t appreciate the bad press.
Before you knew it Ovitz’s bad boy buddy - Private Detective “to the stars”, Anthony Pellicano, was being accused of hiring goons to terrorize the two reporters. He denied it all. Just as he later denied the fed’s charges of wiretapping and racketeering. Pellicano was convicted of those charges last year and is spending the next 15 years in prison.
But back to the allegations about threatening those reporters … Anita Busch in particular. Now, Mr. Tough Guy Pellicano (you can read what he did to me when I worked as a reporter in Hollywood here) is back in court facing THOSE charges.

The case of the shattered windshield, a dead fish and a rose is finally moving forward. Hollywood private eye Anthony Pellicano and his alleged hired hand, Alexander Proctor, pleaded not guilty Wednesday to charges that they threatened reporter Anita Busch in 2002 to scare her off a story.

Trickling water, scrub oaks and rock. Where light enters the ring of trees. Settles on the rock where I sit. Circle of stones. Blackberry bush. (3 boys passing a smoke at the top of the path.) Underneath shade. Contemplation. A low flying plane. Bird cracking. Butterfly. Native garden The grinding sound of a saw or jackhammer. The whirling sound of a motorbike passing. Here the tree leans from one edge of the creek and crosses over to the other side, pale green leaves hang down over the large rock––a flat space for sitting, square ledge for leaning back. Tuft of grass. Dangling branches falling through. A Blue Jay sits at the top of the tree. Nest, brown and wet looking. One singular branch, brief hammering noise, extending arms into the ground. Where a long metal tube or shaft crosses the stream. Vines, ivy, oak and dirt, the sun slowly lowering, light moving to the right.

On this side of the creek a path leads up to an area with even more trees. There is a road. It seems quiet there. I wonder if that is where the creek begins. Blue sky. Thin scrubby oak. Singular. There is a telephone poll up near the road. I hear a car drive past. Faint sound of people talking. Here it is an oasis and yet strangely close to all the city noises. Blue sky turning with hazy late afternoon clouds, flies buzzing about. One leaf falling to my left. A white cat with a square shaped gray patch on its back walks down the trail opposite where I am sitting. It begins to cross the iron tube that stretches across the creek, stops then walks back. It scratches its chest, then runs back up the trail. Vague remnants of a porch on the other side of the hill. Dog barking. Light hitting the tips of red leaves.

Understanding factors that influence Individuals Willingness to Act to Reduce Climate
Change Mitigating the impacts of climate change by reducing global greenhouse gas
emissions will require individuals to change their personal consumption choices and
political decisions. Individual’s personal and political behavior and their consumption
choices are primary causes of greenhouse gas emissions. Furthermore, individual behavior
and demand are primary drivers of government decisions to implement climate change
reduction policies and business decisions to offer low‐carbon products and services. In this
study we investigate factors that influence individuals’ willingness to undertake climate
change reduction behaviors. Our results suggest that positive attitudes towards climate
change reduction behaviors are the strongest predictor of individuals’ willingness to act to
reduce climate change. We also found that positive attitudes are influenced by belief that
climate change is occurring, knowledge of the causes of climate change and perceived
likelihood that climate change will have personally relevant consequences. The proposed
model explains over 75% of variation in willingness to act to reduce climate change in our
sample. These findings have important implications for policymakers, educators, and others
who are working to reduce climate change impacts. For example, campaigns aimed at
motivating individuals to increase their adoption of climate change reduction behaviors
should focus on (1) proving that climate change is occurring; (2) clarifying the causes of
climate change; and (3) portraying the impacts of climate change as both personally
relevant and likely to occur.

Dimond boys knock off Soldotna

Fifteen years of organized soccer for Dimond senior Connor Shuck comes to a conclusion this weekend in the Alaska School Next fall he'll be living in Missoula, Mont., a freshman at the University of Montana. He doesn't plan to try out for the Grizzlies' soccer team. He'd rather focus on getting a degree in athletic training.
So in the meantime, he's living it up at Anchorage Football Stadium and doing his part to help Dimond win its first state championship since 2002.
Shuck scored on a penalty kick Wednesday to lift Dimond to a 5-2 first-round victory over the Soldotna Stars.
"We played as a team, working with the ball and just having fun," said the defenseman, who netted his second goal of the season. "You get goals and it makes it nice."Activities Association's state tournament.

Veterans Have Earned Their Day in Court

In America everyone is supposed to be equal in the eyes of the law. But we've got a growing group, a particular class of defendants entering American courtrooms who I believe need special consideration. They are soldiers returning from war. Several studies conclude that between 30 percent to 40 percent of the approximately 1.6 million vets of Iraq and Afghanistan will "face serious mental-health injuries" like Post Traumatic Stress Disorder and problems from traumatic brain injuries. Experts in the field report both those conditions are linked to anti-social and criminal behavior. Now, to me those numbers — up to 40 percent of the troops afflicted — seem high. But if it's even half that, it's too many brave souls returning home needing special help. So, what do we do with a soldier, who put his or her life on hold to go to a foreign land to fight for our liberty, when they come home and get into trouble with the law? To be clear, I'm not referring to the highly publicized cases where a returning soldier has committed murder. Those cases have caused many to think, "Well, you train these young men to kill, they come home and kill." But there is no research — let me repeat that, there is no research — to indicate vets commit violent crimes more often than civilians. In fact, if you extrapolate government statistics for murders committed by men ages 18 to 24, it's the civilian who is more likely to kill someone, not the vet. I'm referring here to those anti-social, behavioral problems experts report that so many of our returning soldiers suffer with in silence. Problems with substance abuse, paranoia, flashbacks and bursts of unexplained temper, problems so debilitating the vet takes out their frustrations on loved ones or commits suicide.

The right sino-atrium and left atrium differed in sensitivity to the drugs. The various responses, including treppe, are consonant with the theory of the release from the tissues of a potentiating substance and a depressing substance. Histological stains for chromaffin tissue, a possible source of potentiating substance, were negative, but a differentially stained type of cardiac muscle, a possible conducting tissue, is present in regions of the sinus venosus and both atria and at the base of the interatrial septum.

Diane Dimond on the Biological Father of MJ’s Kids

“I have to say the large bathtub and the bed were truly fabulous. We will not stay again, however for several reasons. One, it was not clean. We thought the lobby had the ambiance of a car dealership which it resembles. It is right next to Wal-Mart. The court is just a bunch of weeds. I think the fact that it wasn't clean really put us off. Indeed they had down comforters on the very comfortable beds, but we wondered how often they change the duvet cover. We were there for a much needed get away and it was a big let down.”

I have had the advantage of reading a draft of the speech of my noble and learned friend Lord Hoffmann. For the reasons he gives I would dismiss this appeal. The only point on which I differ from Lord Hoffmann concerns the measure of damages which would have been recoverable had the claim not been dismissed. The point is of general importance to accident car hire companies and to insurance companies operating in this field.
These proceedings arise out of an everyday occurrence. Momentary inattention by a driver results in his car running into and damaging another vehicle. The damaged car needs repair and is off the road for some days while being repaired. The owner of the damaged car requires a replacement vehicle. Many car insurance policies make no provision for a replacement if the insured car is damaged in an accident. So the victim of a no fault accident has to make his own arrangements to tide himself over the days he is without his car.
Under an ordinary car hiring arrangement, the hirer has to produce the hire charge up front. Usually the amount of money involved is not large, but for many people it is still a considerable sum to have to find. Further, there is no certainty the money will ever be recovered from the insurers of the car whose driver was at fault. The innocent motorist has no clout when it comes to seeking payment from someone else's insurers. And no one would wish to become involved in court proceedings to recover the money from the insurers. So there are many cases where innocent motorists make do as best they can. They manage somehow without a car, or borrow one from a relation, or get lifts from friends. Either that, or they hire a car and write off the hire charge as just one of those things.

Dimond Canyon - Oakland

Project BackgroundDimond Canyon is a 80 acre wild open space area tucked into the developed hills of Oakland near the intersection of Hwy 13 and Park Blvd. The park had some extensive public works projects in the past that urbanized the stream. Since then there have been several projects to bring much of it back to a natural setting. The hills are steep in the area. A trail network was built by the city and some with significant help from the Bicycle Trails Council of the East Bay. Currently the BTCEB works on trail maintenance and a bike patrol in the park. There is also a very active natural resource group. Friends of Sausal Creek are actively working on non-native removal and habitat restoration.
Trail DescriptionV-O-Cal will actively work to engage both existing groups along with additional V-O-Cal volunteers to do extensive trail repair, standard brushing work and habitat restoration. Some trails need switchback maintenance. There are at least two sections of fence needed to improve safety. We will create a safe and sustainable path to the creek in several areas where users are currently “sliding down” steep hillsides not intended for trails. We will also work with the Friends group to bring additional human resources to the restoration work they have been doing for some time.

Chugiak softball team ends season tied with Dimond

Although the season is over, Chugiak High girls softball coach Jim Huber did not yet know the team’s order of finish in the seven-member league - at least not by Sunday evening.
Huber confirmed that with the squad’s 11-10 loss to Dimond Saturday, the two teams finished with an identical 8-win-4-loss record in regulation Cook Inlet Conference play. East is a solid first-seed, and Bartlett is fourth, he said.

Chugiak shortstop Kayleigh Vergnetti is accompanied toward the dugout by classmate Mariah Bookbinder after Vergnetti was hit near her left eyebrow by a ground ball Saturday. The cut required seven stitches, but Vergnetti was back for the team's game against Homer later in the day.

The Mustangs had the game against Dimond well in hand, leading 7-4 going into the last inning, Huber reported, when a couple of errors along with a mental mistake opened the door for Dimond, allowing the Lynx to score three runs and send the game into extra innings.
Both teams scored three runs in the eighth inning, leading to yet another extension of the contest.
Dimond scored one in the ninth, then held the Mustangs scoreless, after Chugiak pushed a runner to third base with only one out, Huber reported.
Chugiak sophomore pitcher Ashley VanRyn took the loss in the circle. Interestingly, her father, Cameron, is the coach for Dimond.
The game was dealt an unfortunate turn for the Mustangs in the top of the third inning, when recent graduate Kayleigh Vergnetti, the team’s shortstop, was struck in the head due to a sharply hit grounder, with the blow solidly squared on her left brow. The injury caused a good deal of blood, filling the girl’s palm with blood in the short walk to the team’s third base dugout, resulting in a short delay to the game.
Vergnetti was accompanied by her parents to the hospital where she received seven stitches and was back in the team’s dugout for a non-conference game with Homer hours later.
Huber said that while he respected the youth’s desire to get back into action, he kept her on the bench during the team’s 5-1 win over the Mariners. The coach said that Vergnetti, who also bats cleanup in the team’s offensive order, would be back for Cook Inlet Conference tournament play.

Dimond girls pile up huge Class 4A win

FAIRBANKS — That the Dimond Lynx repeated was no surprise, but their margin of victory sure was.
The Lynx, with four wins and a host of point scorers, tallied 95 points to nearly double their nearest pursuer on Saturday at the Class 4A girls Alaska Track and Field Championships at Lathrop High School.
“We didn’t think we’d win it by this much,” said sophomore Jessica Todd, who claimed the long jump, placed fourth in the 400-meter run and ran the anchor leg of Dimond’s second-place 4x400 relay.
Juneau-Douglas was second with 49 points, followed by Kenai with 47 and Bartlett with 42. Lathrop took eighth and West Valley 14th among 20 scoring teams.

Veterans Court

In America, everyone is supposed to be equal in the eyes of the law. But we've got a growing group, a particular class of defendants entering American courtrooms that I believe needs special consideration. They are soldiers returning from war.
Several studies conclude that between 30 percent to 40 percent of the approximately 1.6 million vets of Iraq and Afghanistan will "face serious mental-health injuries" like Post-Traumatic Stress Disorder and problems from traumatic brain injuries. Experts in the field report both those conditions are linked to anti-social and criminal behavior.
Now, to me those numbers — up to 40 percent of the troops afflicted — seem high. But if it's even half that, it's too many brave souls returning home needing special help. So, what do we do with a soldier, who put his life on hold to go to a foreign land to fight for our liberty, when he comes home and gets into trouble with the law?
To be clear, I'm not referring to the highly publicized cases where a returning soldier has committed murder. Those cases have caused many to think, "Well, you train these young men to kill, they come home and kill." But there is no research — let me repeat that — there is no research to indicate vets commit violent crimes more often than civilians. In fact, if you extrapolate government statistics for murders committed by men ages 18 to 24, it's the civilian who is more likely to kill someone, not the vet. I'm referring here to those anti-social, behavioral problems experts report that so many of our returning soldiers suffer from in silence. Problems with substance abuse, paranoia, flashbacks and bursts of unexplained temper — problems so debilitating the vet takes out his frustrations on loved ones or commits suicide.

Dr. Ralph Wilson “Docky” Dimond, age 88, of Lamar, passed away Friday, June 19, 2009, at Freeman Hospital West in Joplin.Docky was born September 19, 1920, in his family home in Lamar, to Dr. Walter & Emma (Booten) Dimond. After graduating from Lamar High School in 1938, Ralph attended Missouri State University in Springfield and went on to earn a doctorate degree in dentistry from UMKC in Kansas City. From 1943 through 1946 he served in the Navy aboard the USS Zania in the Pacific Theater, Solomon Islands, Philippines, and Okinawa. Returning home to Lamar after the war, Docky began his 43 year career in dentistry, partnering first with his father, then in his own practice until retiring in 1982.

Dimond Park Pool

BACKGROUND
On October 2, 2007 voters approved Proposition 4, authorizing the issuance of $19.8 million in general obligation bond debt for paying for the construction of a pool facility in Dimond Park. A portion of this project will qualify for State reimbursement under the State's School Construction Bond Debt Reimbursement Program.

The Voter Information for October 2, 2007 Municipal Election stated that an approximately 33,700 sq. ft swimming facility would be constructed. Plans call for 6-lane lap pool with diving board and a zero-entry warm water pool for learn-to-swim-programs, a reduced water recreation area, senior aerobics, and other water safety programs. Locker rooms, spectator seating, mechanical rooms, and small administrative areas would also be constructed.

On October 13, 2007 at he CBJ Assembly Retreat, the Assembly updated the goal of "revised the strategy for construction of a Valley Community Center" to "monitor design, construction and management of Valley Pool." The Assembly heard from staff that a pool task force would be working with CBJ Staff on design of the pool

Abstract:

Brown and Jeeves (1993) found that an evoked potential estimate of interhemispheric transfer time, from the left to the right hemisphere, correlated negatively with a bilateral field advantage (BFA) in a response-choice letter matching task. We implemented a go no-go dot size matching task to determine whether the crossed-uncrossed difference (CUD) in reaction time, commission errors and omission errors (estimates of the "cost" of interhemispheric transfer) would correlate with BFAs in data from the same experiment and whether the type of decision ("same" versus "different") would modulate the CUDs and/or BFAs. Sixteen normal right-handed subjects were tested. The CUDs were negatively correlated with the BFAs. Canonical correlation analysis of this set of relations was highly significant (r = .95). Estimates of left-to-right relay were far more strongly related to BFA (p = .0001) than were estimates of right-to-left relay (p = .03). "Same" decisions yielded a unilateral field advantage and "different" decisions a bilateral field advantage in omission error data, this crossed interaction reaching significance. More efficient interhemispheric relay favored BFAs, i.e., strongly suggesting in such cases an advantage of interhemispheric over intrahemispheric integration. This effect appeared to be markedly asymmetric. Furthermore, resource sharing within and between the hemispheres was a function of the "same" versus "different" dimensions of the decision to be made, especially in omission errors. The opposite dissociation occurred less markedly in the reaction times, this double dissociation reaching significance, revealing presence of a subtle speed-accuracy trade-off in interhemispheric dynamics.

Jonathan Dimond

This recording documents some of my compositions from the time of my departure from Australia in 2002, through 2004.Within this 3 year period I was based in Los Angeles, USA, but also spent time in Tokyo, Japan, and Amsterdam, Holland where new compositions were inspired. The process of composition for me has always been about discovery and invention, most often also with specific people and/or places in mind.In this way, it is very similar to a journey - a kind of personal journey whereby problems arise and are overcome by solutions that are very often specific to that situation. The more experience a composer has in creating customized solutions, the more adept and able they are, in my opinion. The element of surprise in the journey is also intrinsic to composition for me. A dramatic change in environment brings new people and places your way, and forces you to reexamine many aspects of your voice and your existence. The process of recording allows a self-focused "magnifying glass" to zone-in further on yourself, your musical partners, and your composition. Of course the subsequent benefit is that your journey has been documented - preserved for future self-reflection and also for the ultimate reward - sharing with audiences. The communication of ideas with audiences through a rich musical language is really the essence of my musical motivation.This album project aims to bring me closer to sharing music and my journey with others. A Short History of Dimond Canyon and Sausal Creek

Extending from the Montclair hills to Dimond Park near Fruitvale Avenue and Macarthur Boulevard is an expanse of wooded open space called Dimond Canyon. Hundreds of cars drive by the canyon on Park Boulevard every day. Only a few enjoy the wildlife of the canyon at its best, by hiking the trails that run through the woodlands. Some of these trails have been used since people first inhabited these hills. At the head of the canyon, near Highway 13, Cobbledick Creek (which runs along Scout Road) joins Shephard Creek (which runs under Shepherd Canyon Road). On the bay side of the freeway, near the parking lot of the Montclair Golf Course, these creeks join Palo Seco Creek (which runs through Joaquin Miller Park) and unite to form Sausal Creek which runs through the bottom of Dimond Canyon. Huchiun and Jalquin tribes of Ohlone Indians were concentrated in the area surrounding Dimond Canyon. One well-known Indian village was located in Indian Gulch, the area currently called Trestle Glen. Another known village was located on the campus of Holy Names College. Dimond Canyon was between them. The hillsides of the canyon would have been great sites for harvesting acorns, berries, and edible plants, and hunting for birds, fish, and other wildlife. In 1820, the land including Dimond Canyon was granted to Luis Maria Peralta. Peralta owned all the land from El Cerrito to San Leandro, but he chose to place his first home on the flatlands between Peralta and Sausal Creeks. Peralta divided his land among his sons in 1842 giving the San Antonio section including Dimond Canyon and his original home to his son Antonio Maria Peralta. Around 1847, Europeans set up camp in the upper hills of Antonio Peralta's land, and started logging the San Antonio redwood forest. In 1850, the area's first steam sawmill was built at Palo Seco Creek in the head of Dimond Canyon (see photo in The Montclarion February 3, 1998). A logging road high on the side of the Canyon, now Park Boulevard, was used to transport the logs through Dimond Canyon. By 1860, ten years later, the San Antonio forest was logged completely.

Team 568 - Nerds of the North

Here you can find information about Team 568, based in A.J. Dimond Highschool up in the snowy Anchorage, Alaska. The 2009 season has proven to be one of our most challenging yet, though we are pushing through. Our FIRST Robotics Competition team will be flying to the Pacific Northwest to attend and participate in the Portland, Orgeon regional.
The FIRST Tech Challenge regional in Fairbanks, Alaska was a success! The Dimond team, Team 3208, won the innovation award for our creative puck collection system, and the East High robotics team won the competition and was invited to the World Festival in Atlanta, Georgia this April.

Diane Dimond

Diane Dimond is a Clinical Professor of Law and the director of Legal Writing at the Duke University School of Law. She teaches the first-year course in Legal Analysis, Research, & Writing and two upper-level seminars, Negotiation and Contract Drafting.
Professor Dimond received her B.A. in political science and French from the University of Iowa in 1973, and her J.D. from the Harvard Law School in 1977. She began her practice of law in New York City at a major Wall Street firm in the litigation department, and after six years, moved to North Carolina, where she continued her practice in litigation, first as an associate and later as a partner, in a large North Carolina firm. Her major practice area was in commercial litigation, including employment-related litigation and advice, defense of securities fraud actions, trade secrets/intellectual property suits, nuclear power plant construction litigation, personal injury insurance defense, and representation of both corporate clients and foreign governmental bodies in transnational disputes. She has had extensive experience in pre-trial discovery and motion practice, lay and expert witness preparation, appellate brief writing, computerized document management, and settlement negotiations. While most of the matters she handled were filed in state and federal courts, she has also represented clients in a number of arbitration proceedings. After almost 17 years of practice, she joined the Duke Law faculty to teach full time in 1994, and was appointed as Clinical Professor of Law in January 2001. In 2004, she won the Duke Bar Association's Distinguished Teaching Award.

announced today that it has commenced a class action lawsuit in the United
States District Court for the Southern District of Florida on behalf of a
putative Class consisting of all persons and entities who provided moneys to
Defendants George Theodule; Creative Capital Consortium, LLC; A Creative Capital
Concept$, LLC; Dorothy Delisort-Theodule; Yolette Theodule-Williams; Mario
Theodule; Julius Theodule; or Yves Theodule (collectively, the "Defendants"); or
to individuals or entities who were raising funds on behalf of any of those
Defendants, for purposes of "investing" in Defendants' fraudulent Ponzi scheme
(the "Class"), from January 2007 through today and thereafter ("Class Period").

a "zero-loss," and that pursuant to Defendants' investment "strategies," the
Class Members' moneys would double in value every three months. The crux of the

investment returns were dependent on contributions of moneys from new investors;
and (2) that Defendants intended simply to steal the Class Members' moneys
pursuant to a fraudulent Ponzi scheme. Finally, the Complaint alleges that
Defendants have failed to honor the Class Members' withdrawal requests, causing
losses to the Class.
Plaintiffs seek to recover damages on behalf of the Class, and have brought
claims under the Securities Exchange Act of 1934 and the Securities Act of 1933
for fraud in connection with securities transactions and for selling
unregistered securities, as well as claims under the common law for breach of
fiduciary duty and unjust enrichment.

DIMOND - ongoing, but no longer recruiting participants

The Huntington Study Group (HSG) is conducting a study of the research medication Dimebon in persons 29 years of age or older who have mild to moderate Huntington disease (HD). DIMOND is designed to determine safe and tolerable doses of Dimebon and also to determine the effect of Dimebon on cognitive (thinking) and motor (movement) signs and overall functioning of subjects with HD. Approximately 15 research centers in the United States and in the United Kingdom enrolled about 90 research subjects. The entire time on study drug will last about 3 months. The study enrolled research subjects with early to moderate signs of HD who are independently ambulatory (walking) and self-sufficient in activities of daily living, such as eating, dressing, and bathing. Enrollment began in the Summer of 2007, and was completed in March 2008. The study is sponsored by Medivation, Inc.

SENTINEL Project

The SENTINEL project will coordinate a programme of research across a consortium of partners from sixteen European Union member states, four candidate member states.
There is growing concern among healthcare professionals and patients about the use of radiation to produce scans, X-rays and other images of the human body.
Technological developments, led by equipment manufacturers from across Europe, have not been sufficiently supported by studies to ensure these new digital imaging devices and techniques are as effective as they might be or give the lowest possible radiation dose.
SENTINEL will look at the safety and effectiveness of the radiological imaging systems involved in almost 90% of examinations performed in Europe. These systems contribute to 60% of the total radiation dose from medical procedures and approximately half of the radiation the public is exposed to from man-made sources.
